Divorce & civil partnership dissolution
Nobody plans for a divorce or the dissolution of their civil partnership, but we can offer expert advice and support to guide you through this difficult process:
- Guidance on the various routes available to you
- Practical advice in dealing with all financial matters
- Advice on arrangements for any children of the family
Above all we will take all your circumstances into account before advising on the most appropriate way forward, whether this is negotiating settlement on your behalf, or making applications to the court to bring about a quick resolution to the situation.
As a member of Resolution our advice is non-confrontational, practical and constructive, in accordance with Resolution’s Code of Practice.
Separation
If you and your partner are undergoing a period of separation and are unsure as to whether you wish to actually divorce, you may wish to protect your financial interests during this time.
We can assist you in the preparation of a Separation Agreement (otherwise known as a Deed of Separation), which will protect the respective financial interests of both you and your partner, even if you have not yet decided on your future.
Although not a formal Court Order, this will detail the agreed terms and can be used in any subsequent divorce proceedings provided it has been followed amicably.
Cohabitation disputes
With a growing number of couples choosing to live together but not marry, there has also been a growth in problems arising from the breakdown of such relationships.
As cohabiting couples have no special status under the law, they can find themselves going through a difficult process with limited clarification of what happens next or the rights that they have.
If you find yourself in such a situation, we can provide sensible and practical advice. Our non-confrontational and constructive approach will help you deal with any matters arising from the end of your relationship – including arrangements for financial assets and children, allowing you both to move on without any loose ends.
Prenuptial agreements & cohabitation agreements
You may wish to protect your financial interests in the potential event of a marriage or relationship breakdown and Prenuptial and Cohabitation Agreements can help you do exactly this.
We can guide you through this process before you and your partner marry or move in together, giving you peace of mind that your respective financial assets are protected should the situation ever arise.
Private law children disputes
We know that one of the most distressing aspects of a relationship breakdown can be managing the continuing relationship of the absent parent with their children.
As such we will provide all the necessary guidance and advice you need to navigate this situation, endeavouring to negotiate a settlement and put in place a structure which is in the children’s best interests.
If a breakdown cannot be resolved in this matter we will guide you through the court procedure if necessary, doing all we can to ensure both parents remain involved in all aspects of their children’s lives.
